S.L. 433.13 Art. 20Equivalence.

(1) Vegetable propagation and planting material produced in a third country shall afford the same guarantees as regards obligations on the supplier, identity, characteristics, plant health, growing medium, packaging, inspection arrangements, marking and sealing. It shall be equivalent in all respects to vegetable propagation and planting material produced in the European Union and complying with the requirements and conditions of these regulations.

(2) Pending the decision referred to in subregulation (1), Malta may, until the 31st December, 2022, apply to import vegetable propagation and planting material from third countries which have conditions at least equivalent to those laid down temporarily or permanently in the schedules referred to in regulation 7. Where no such conditions are laid down in the said schedules, the import conditions must be at least equivalent to those applicable to the production in Malta.

(3) Vegetable propagation and planting material imported to Malta in accordance with a decision taken by the country shall be subject to no marketing restrictions in the other Member States as regards the matters referred to in subregulation (1).
