Cap. 600 Art. 7Instrument of delegation.

(1) The Minister may, by means of an instrument of delegation, transfer surveillance and enforcement powers to the Authority.

(2) In accordance with the provisions of article 6(5) the Minister shall, by means of an independent review, monitor the exercise of the power delegated under sub-article (1) in order to ensure that such delegation is being exercised in terms of the instrument of delegation and in terms of the provisions of articles 4 and 5.

(3) If, on the basis of sub-article (2), the Minister finds that the Authority has not exercised its powers under the instrument of delegation in accordance with the provisions of the said delegation and the provisions of this Act, the Minister shall withdraw the relative instrument of delegation.
