Cap. 108 Art. 8No fees due if witness is present in court.

(1) No person shall be entitled to the prescribed fees and expenses if, not having been previously subpoenaed or requested by a party in a matter pending before any court to attend at the court to give evidence, he is, at the time he is called to give evidence, at the place in which the court is sitting.

(2) The provisions of subarticle (1) shall not apply if the witness is kept after giving evidence so that he may again be called to give evidence.
