Cap. 16 Art. 1444Right to interest of party against whom redemption is exercised.

The party against whom the said right is exercised is entitled to interest from the day of the respective disbursements which according to the last preceding article are to be refunded to him, subject, however, to the deduction of the value of the fruits which, as from the day of the sale giving rise to the exercise of the right of redemption he or any other former possessor has collected or by the use of the diligence of a could have bonus paterfamilias collected: Provided that he may retain the fruits aforesaid and waive his right to interest.
