Cap. 16 Art. 1108Where creditor discharges one of the co-debtors from his joint and several liability.

Where the creditor has renounced his joint and several right of action with respect to one of the debtors, and one or more of the other debtors becomes or become insolvent, the shares of those who are insolvent shall be apportioned amongst all the debtors, including those previously discharged by the creditor from their joint and several liability, in proportion to each one’s share of the debt.
