Cap. 16 Art. 1107Co-debtor discharging debt may only claim from the other co- debtors their respective shares.

(1) Where one of the co-debtors has wholly discharged a joint and several debt, he may only claim from the other co-debtors the share of each of them, together with interest as from the day of payment, notwithstanding any assignment of rights.

(2) Where one of such other co-debtors is insolvent, the loss occasioned by such insolvency shall be apportioned amongst all the solvent co-debtors, including the one who has made the payment, in proportion to each one’s share of the debt.
