Cap. 16 Art. 805Partition per stirpes and per capita.

(1) In all cases in which representation is allowed, the partition shall be made per stirpes.

(2) Where in one and the same stock there are several branches, the sub-partition shall be made in each branch; and the per stirpes partition among the members of the same branch shall be made per capita.
