Cap. 16 Art. 2079Liability for deteriorations.

(1) Any deteriorations caused in consequence of gross negligence on the part of the third party in possession injuriously affecting the interest of the hypothecary creditors, give rise to an action for indemnity against him.

(2) He cannot claim reimbursement in respect of the expenses and improvements made by him, except as provided under paragraph (b) of article 2010.

(3) He has no right of retention on account of improvements.
