Cap. 16 Art. 1762When special curator may be appointed.

(1) Where in the cases referred to in articles 1758, 1759 and 1760 the parent, the legitimate ascendant, or the tutor or curator neglects or without just cause refuses to accept the donation, the court shall, upon the demand of any person, appoint a special curator for the purpose.

(2) The same shall apply where the person making the demand declares on oath that he does not know whether the minor has any parent or legitimate ascendant alive or that he does not know where any such parent or ascendant is to be found, and the court is of opinion that the donation is advantageous to the minor.
