S.L. 545.43 · Promotion Of Energy From Renewable (S.L. 545.43)
S.L. 545.43 Art. 47Assessing and addressing barriers to renewables deployment. S.L. 545.34. S.L. 545.34.
PART V
(1) The deployment of renewable electricity to a level that is consistent with Malta’s contribution to the Union’s targets and at a pace that is consistent with the indicative trajectories referred to in point (a)(2) of Article 4 of Regulation (EU) 2018/1999 shall, without prejudice to Malta’s exercise of the derogations from Articles 4 and 6
of Directive (EU) 2019/944, be enabled by the applicability of regulation 54A of the Electricity Regulations which shall, subject to the conditions therein, provide for the purchase of all renewable electricity produced in Malta and exported to the grid.
(2) A summary of the policies and measures addressing barriers to a high level of renewable electricity supply, including those related to permit-granting procedures and to the development of the necessary transmission, distribution and storage infrastructure, including co-located energy storage, where such barriers are not associated with the exercise of the derogations referred to in sub-regulation (1), together with an assessment of their implementation, shall be included in the integrated national energy and climate plans submitted pursuant to Articles 3 and 14 of Regulation (EU) 2018/1999 and in the integrated national energy and climate progress reports SOURCES
submitted pursuant to Article 17 of the said Regulation.
(3) The policies and measures referred to in sub-regulation
(2) shall take into account the additional renewable electricity required to meet demand in the transport, industry, building and heating and cooling sectors and for the production of renewable fuels of non-biological origin.
(4) Based on the outcome of the relative assessments of any existing regulatory and administrative barriers to long-term renewable energy purchase agreements, where such regulatory and administrative barriers are independent of Malta’s exercise of the derogations from Articles 4 and 6 of Directive (EU) 2019/944, the Minister shall, without prejudice to the continued exercise of such derogations, remove unjustified barriers to, and promote the uptake of, such agreements, including by exploring how to reduce the financial risks associated with them, in particular by using credit guarantees:
Provided that during the subsistence of the exercise of such derogations, regulation 54A of the Electricity Regulations shall continue to apply to the purchase of all renewable electricity produced in Malta and exported to the grid, subject to the conditions therein.
(5) The agreements referred to in sub-regulation (4) shall not be subject to disproportionate or discriminatory procedures or charges, and any associated guarantees of origin shall be transferable to the buyer of the renewable energy under the renewable energy purchase agreement.
(6) Any policies and measures promoting the uptake of the renewable energy purchase agreements referred to in sub-regulation
(4) shall be described in Malta’s integrated national energy and climate plans submitted pursuant to Articles 3 and 14 of Regulation (EU) 2018/1999 and the integrated national energy and climate progress reports submitted pursuant to Article 17 of the said Regulation.
(7) The progress reports referred to in sub-regulation (6) shall also provide an indication of renewable energy generation that is supported by renewable energy purchase agreements.
(8) Sub-regulations (4) and (5) shall be without prejudice to the exercise of the derogations granted under Article 66 of Directive
(EU) 2019/944.
