Cap. 16 Art. 511When partition is tobemadewiththe assistance of the judge or magistrate.

(1) Where any of the co-owners is subject to tutorship or curatorship, or is an absentee represented by a curator appointed by the court, the partition is null unless it is made with the assistance of the judge or magistrate of the court of voluntary jurisdiction.

(2) The judge or magistrate shall countersign the draft deed.

(3) A partition made with the assistance of such judge or magistrate cannot be impeached, even by the persons mentioned in sub-article (1) of this article, on the ground of non-compliance with the rules laid down in the foregoing articles.
