Cap. 16 Art. 2130Time within which act is to be served. Cap. 12.

(1) No interruption takes place if the act is not served before the expiration of one month to be reckoned from the last day of the period of prescription.

(2) Nevertheless, if the party to be served is absent from Malta, service shall be deemed to be effected by the publication of a notice in the Government Gazette, within a month to be reckoned from the last day of the aforesaid period, on the demand of the party filing the act, as provided in the Code of Organization and Civil

Procedure.

(3) The said notice shall contain a summary of the act of interruption, and shall be signed by the registrar of the court before which the act has been filed.
