Contracts made outside Malta, by any public or authentic instrument, according to the laws of the place, or before the diplomatic or consular representative of the Government of Malta in that place or a person serving in the diplomatic, consular or other foreign service of any country which, by arrangement with the Government of Malta, has undertaken to represent that Government’s interests in that place or a person authorized in that behalf by the President of Malta, can create a hypothec over property existing in Malta, if the competent civil court, on the demand of the creditor, by sworn application, shall have ordered the registration thereof.
