Cap. 16 Art. 2024Who can contract conventional hypothec.

(1) A conventional hypothec can only be contracted by persons who are capable of alienating the property which they charge with such hypothec.

(2) The property of persons who are not capable of alienating cannot be hypothecated by contract except for the causes and in the form established by law.
