Cap. 16 Art. 1605Annulment of conditions of new leaseontheground of misrepresentation etc.

(1) Notwithstanding the acceptance of the conditions of the new lease, it shall be lawful for the party who had accepted such conditions to demand, during the lease, the annulment of all

, such conditions together with damages, if he proves any misrepresentation or fraud to his prejudice in regard to any of such conditions; and in such case the new lease shall remain operative on the same conditions of the previous lease, at a rent to be fixed on a valuation by experts having regard to the circumstances prevailing at the time when the conditions so impeached were accepted.

(2) The action for damages on the ground of misrepresentation or fraud as aforesaid, may even be exercised within a year from the dissolution of the new lease, but not after the expiration of such year.
