The same rule shall apply where a person has bound a himself to deliver goods to arrive on a ship named in the contract and fails to make delivery within the time agreed upon, unless he proves that he used due diligence for the goods to arrive within the time agreed upon and that the default of arrival of such goods within such time was due to a vis major.
