Cap. 16 Art. 1173When debtor can deposit sum or thing due. Cap. 12.

(1) Where the creditor refuses to receive payment, the debtor, or the person who can legally make payment, may, at the expense of the creditor, deposit the sum or thing due in the manner laid down in the Code of Organization and Civil Procedure.

(2) A deposit validly made shall be equivalent to payment, and the thing deposited shall remain at the risk of the creditor.
