Cap. 16 Art. 1167Subrogation takes place both against sureties and debtors.
Sub-title V
Subrogation, whether by agreement or by operation of law, takes place against both the sureties and the debtors; but shall not operate to the prejudice of the creditor when he has only been paid in part; and, in any such case, the creditor may claim the balance due to him in preference to the person from whom he shall have received the part payment.
