Cap. 16 Art. 1117Right of co-heir of debtor to demand that the other co- heirs be made parties to the suit.

The heir of the debtor, on being sued in respect of the whole debt, may demand an adjournment to join his co-heirs as defendants in the suit, provided the debt be not of such nature that it can only be discharged by the heir so sued, in which case judgment may be given against such heir alone, saving his right of relief against the other co-heirs.
