Cap. 16 Art. 1056Obligationisnull contracted under condition depending solely upon obligor.

(1) Where an obligation is contracted on a condition if which makes the obligation depend solely upon the will of the obligor, the obligation is null.

(2) Nevertheless, where the obligation depends upon an event the happening of which is within the power of the obligor, he is bound if the event happens.
