Any premises, open air spaces or underground works being a poultry, dairy or other farm or horticultural establishment:

Provided that -

(a) such premises, spaces or works are used by way of a connection with trade or for, or in connection with, the purposes of gain, and

(b) persons other than members of the family of the employer are employed therein in manual labour.
