(1) As regards the products and services referred to in regulation 3 of these regulations, the accessibility requirements set out in Annex I to these regulations shall constitute mandatory accessibility requirements within the meaning of the Public Procurement

Regulations, the Public Procurement of Entities operating in the Water,

Energy, Transport and Postal Services Sectors Regulations, the

Emergency Procurement Regulations and the Concession Contract Regulations.

(2) Any product or service, the features, elements or functions of which comply with the accessibility requirements set out in Annex I to these regulations in accordance with Section VI thereof shall be presumed to fulfil the relevant obligations set out in legislation other than these regulations, as regards accessibility, for those features, elements or functions, unless otherwise provided in those other acts.
