S.L. 549.50 Art. 6Classification system for waste facilities.

For the purposes of these regulations, waste facilities shall be classified in one of the following categories:

(1) Category A waste facility: any waste facility meeting the criteria set out in Schedule 3 or any waste facility designated for the accumulation or deposit of hazardous waste generated unexpectedly for a period of more than six months; or

(2) Category B waste facility: any waste facility designated for the accumulation or deposit of non-hazardous non-inert waste for a period of more than one year; or

(3) Category C waste facility: any waste facility designated for the accumulation or deposit of unpolluted soil, non-hazardous prospecting waste, waste resulting from the extraction, treatment and storage of peat and inert waste for a period of more than three years:

Provided that Category A, Category B and Category C waste facilities are deemed to include any dam or other structure serving to contain, retain, confine or otherwise support such a facility, and also to include, but not be limited to, heaps and ponds, but excluding excavation voids, whether created through surface or underground extraction.
