S.L. 370.32 Art. 5Written contract.

(1) The collective investment scheme or the fund manager on behalf of the scheme shall ensure that a depositary is appointed.

(2) The appointment of the depositary of a collective investment scheme pursuant to sub-regulation (1) shall be evidenced by a written contract also referred to as the custody agreement.

(3) The depositary agreement shall, regulate the flow inter alia, of information deemed to be necessary to allow the depositary to perform its functions for the scheme for which it has been appointed as depositary in accordance with these regulations.
