S.L. 276.8 Art. 44Order for return to scheduled country following consent.

(1) This article applies if a person consents to his return under article 43.

(2) Article 15(5) of the relevant Act shall apply.

(3) If the court has not fixed a date under article 11 on which the extradition hearing is to begin it is not required to do so.

(4) If the extradition hearing has begun the court is no longer required to proceed or continue proceeding under articles 12 to 31.

(5) The court must within the period of ten days starting with the day on which consent is given order the person’s return to the scheduled country.

(6) Subarticle (5) has effect subject to articles 46 and 49.

(7) If subarticle (5) is not complied with and the person applies to the court to be discharged the court must order his discharge unless reasonable cause is shown for the delay.
