S.L. 16.20 Art. 37Termination of mediation without reconciliation.

Where the mediator’s attempts to reconcile the parties or to bring them to an agreement have failed, or where the mediation period expires in accordance with regulation 19, the mediator shall inform the Judge in writing, who shall then grant the requested authorisation:

Provided that if at any stage of the mediation, the mediator is of the opinion that such reconciliation is unlikely to be achieved or that such agreement cannot be reached, the mediator may inform the Judge before the expiry of the period stipulated in regulation 19 so that the Court may proceed to its decision.
