These regulations shall not apply to concessions awarded by contracting entities where, for the Member State in which such concessions are to be performed, it has been established pursuant to regulation 28 of the Public Procurement of Entities Operating in

Water, Energy, Transport and Postal Services Sectors Regulations that the activity is directly exposed to competition in accordance with regulation 27 of the said regulations.
