Where a decision is taken pursuant to Article 30k of

Directive 2003/87/EC, and by way of derogation from sub-regulation

(1) of regulation 17, the first surrender of allowances in respect of emissions of a regulated entity from the activity listed in Schedule 1

shall take place by 31st May 2029 in respect of emissions occurring in 2028.
