(1) The market surveillance authority shall undertake efforts in terms of article 32A of the Equal Opportunities (Persons with Disability) Act to ensure adequate and effective compliance with these regulations.

(2) Consumers, as well as public bodies or private associations, organisations or other legal entities which have a legitimate interest, and are acting on behalf of said consumers, may take or support appropriate action to ensure that the rights of the consumers in terms of these regulations are complied with, in terms of ACT)

article 3 of the Act, and through any other means of redress available in terms of applicable legislation from time to time.

(3) This regulation shall not apply in respect of procurement procedures which are subject to the Public Procurement Regulations, the

Public Procurement of Entities operating in the Water, Energy,

Transport and Postal Services Sectors Regulations, the Emergency

Procurement Regulations or the Concession Contract Regulations, in which respect other applicable legislation as in force from time to time shall apply.
