(1) Nothing in these regulations shall authorise the Authority to inquire, or request the provider to inquire, into the affairs of any individual student, except for the purpose of ensuring compliance with any of the provisions of these regulations, as subject to the provisions of the Data Protection Act.

(2) Past and present officers of the Authority shall not disclose information obtained from licensees or providers in carrying out their duties under these regulations. Such persons are bound by the obligation of professional secrecy, except for the purpose of the exercise of their functions, or when lawfully required to do so by any court or under a provision of any law.
