(1) A contract having as its object works, supplies or services falling within the scope of these regulations and partly within the scope of the Public Procurement Regulations, or the

Public Procurement of Entities Operating in the Water, Energy, Transport and Postal Services Sectors Regulations, shall be awarded in accordance with these regulations, provided that the award of a single contract is justified for objective reasons.

(2) The award of a contract having as its object works, supplies or services falling partly within the scope of these regulations, with the other part not being subject to either these regulations, or to the Public Procurement Regulations, or the Public Procurement of

Entities Operating in the Water, Energy, Transport and Postal Services Sectors Regulations, shall not be subject to these regulations, provided that the award of a single contract is justified for objective reasons.

(3) The decision to award a single contract may not, however, be taken for the purpose of excluding contracts from the application of these regulations or of the Public Procurement Regulations, or the Public Procurement of Entities Operating in the Water, Energy, Transport and Postal Services Sectors Regulations.
