S.L. 601.12 Art. 41Direct contracts.

Notwithstanding anything included under these regulations, a contracting authority may procure property through a direct contract upon obtaining the prior written approval as provided hereunder:

(a) when the estimated value of a tendering process is in accordance with the threshold established under regulation 6(1)(a), a contracting authority must obtain prior written approval of the Minister who may delegate his authority in writing to the Permanent Secretary or any other senior official in his Ministry;

(b) when the estimated value of a tendering process is in accordance with the threshold established under regulation 6(1)(b), a contracting authority must obtain prior written approval of the Director.
