S.L. 591.5 Art. 7Designation of Notifying Authority.

(1) The Malta Digital Innovation Authority shall be designated as the Notifying Authority for the purpose of Regulation

(EU) 2024/1689:

Provided that the assessment and monitoring referred to in Article 28(1) of Regulation (EU) 2024/1689 shall be carried out by the National Accreditation Board (Malta).

(2) The Malta Digital Innovation Authority may only notify conformity assessment bodies which have satisfied the requirements laid down in Article 31 of Regulation (EU) 2024/1689.

(3) The provisions of sub-article (1) and (2) of this regulation shall apply notwithstanding any provision of law to the contrary.

(4) An appeal shall lie to the Notifying Authority against decisions of the notified bodies, including on conformity certificates issued in accordance with Article 44 of Regulation (EU) 2024/1689 in the manner, as may be prescribed from time to time by the Malta Digital Innovation Authority, by virtue of guidelines or other binding documentation.
