(1) Where personal data are transmitted or made available by another Member State, such data may be communicated or transferred only if that Member State has given its prior authorisation to the communication or transfer.

(2) Communications or transfers without the prior authorisation of another Member State in accordance with sub-regulation (1) may be permitted only if the communication or transfer of the personal data is necessary for the prevention of an immediate and serious threat to public security of a Member State or a third country or to essential interests of a Member State and the prior authorisation cannot be obtained in good time:

Provided that the authority responsible for giving prior authorisation shall be informed without delay.

(3) Sub-regulation (1) shall not apply in cases where the communication of personal data takes place in the performance of a legal task by the competent authority making such communication in FOR THE PURPOSES OF THE PREVENTION, INVESTIGATION, DETECTION OR PROSECUTION OF CRIMINAL OFFENCES OR THE

EXECUTION OF CRIMINAL PENALTIES relation to the particular case for which the data was specifically transmitted or made available.
