S.L. 549.51 Art. 30Prohibited exports.

The competent authority as competent authority of the Member State of origin, shall not authorise shipments:

(a) to a destination south of latitude 60° south; or

(b) to a State which is party to the Partnership Agreement between the members of the African, Caribbean and Pacific Group of States of the one part, and the European Community and its Member States, of the other part, (Cotonou ACP-EC Agreement) which is not a Member State, without prejudice to regulation 4(3) and (4), or

(c) to a third country which does not, in the opinion of the competent authority as competent authority of the Member State of origin, in accordance with the criteria referred to in sub-regulation (1)(b), have the administrative and technical capacity and regulatory structure to manage the radioactive waste or spent fuel safely, as stated in the Joint Convention:

Provided that in coming to an opinion on this issue, the competent authority as competent authority of the Member State of origin, shall take duly into account any relevant information from the competent authorities of other Member States.
