An authorised producer responsibility organisation shall take the necessary measures to ensure that by 31st December 2027, and in any following year, a minimum of five percent (5%) by weight of fishing gear-containing plastic placed on the market in Malta is separately collected as waste for recycling through the systems set up in accordance with sub-regulations (7) and (8) of regulation 4:

Provided that if it results that in any given year, the authorised producer responsibility organisation fails to achieve the said applicable minimum collection target, an administrative penalty as listed in Schedule 6 shall be imposed.
