S.L. 549.134 Art. 6Duration and renewal of licence. 

(1) Subject to the provisions of these regulations, the licence granted by the Agency shall, unless previously renewed or revoked, continue to be valid until such time as it is renewed by the

Agency following an evaluation, which such evaluation shall be based on the terms of the license agreement, as well as any other direct or indirect factors that impact the efficiency of the operation and the management of the Scheme:

Provided that the Agency shall inform the operator of any matters which require its attention in writing so that such matters may be addressed by the operator without delay.

(2) The Agency shall establish the period of validity of the licence:

Provided that such period shall not be longer than twelve

(12) years.

(3) Following the evaluation mentioned in sub-regulation (1), the Agency:

(a) may renew the licence, with or without modifications, for such a further period as specified; or

(b) if, having regard to the provisions of these regulations, it considers it necessary or expedient to do so, may for serious breach for reasons which shall be given in writing refuse to renew the licence.
