(1) There shall be a form, with the title ‘Sworn

Declaration of Conversion of Civil Union into Marriage’, which shall be the form used for conversions for the purposes of article 11 of the

Act and the provisions of these regulations, and shall be the form as provided in the Schedule annexed to these regulations

(2) The declaration of conversion from civil union into marriage shall be made on oath, and signed by each of the parties before the Registrar, stating that all of the information given for the purposes of the conversion is true. SKEDA

In terms of Article 108 of the Criminal Code whosoever shall make a false oath before a judge, magistrate or any other officer authorized by law to administer oaths, shall, on conviction, be liable:

(a) to imprisonment for a term from four months to one year, if the oath be required by law, or ordered by a judgment or decree of any court in Malta;

(b) to imprisonment for a term not exceeding three months, if the oath be not so required or ordered.

Skont l-Artikolu 108 tal-Kodici Kriminali, kull min jaħlef il-falz quddiem imħallef, maġistrat jew quddiem uffiċjal ieħor li jkollu s-setgħa b’liġi li jagħti l-ġurament, jeħel, meta jinsab ħati -

(a) il-piena ta’ priġunerija minn erba’ xhur sa sena, jekk il-ġurament ikun meħtieġ mil-liġi, jew ordnat b’sentenza jew b’digriet ta’ waħda mill-qrati ta’ Malta;

(b) il-piena ta’ priġunerija għal mhux iżjed minn tliet xhur, jekk il-ġurament ma jkunx hekk meħtieġ jew ordnat.

In terms of Article 188(1) of the Criminal Code, whosoever, in order to gain any advantage or benefit for himself or others, shall, in any document intended for any public authority, knowingly make a false declaration or statement, or give false information, shall, on conviction, be liable to the punishment of imprisonment for a term not exceeding two years or to a fine (multa).
