A driver shall further not be considered to be a posted worker for the purpose of these regulations and the Posting of Workers in Malta Regulations when:

(a) the driver transits through the territory of Malta without loading or unloading freight and without picking up or setting down passengers;

(b) performing the initial or final road leg of a combined transport operation, if the road leg on its own consists of a bilateral transport operation.
