S.L. 460.41 Art. 33Power of the Enforcement Committee to impose administrative fines. 

(1) The Enforcement Committee shall have the power to impose administrative fines established by this order, on any entity reported by the CIP Department, or where designated the competent authority, as being non-compliant with this order.

(2) Prior to deciding on whether an entity is compliant with this order, the Committee shall allow the entity to provide documentation or make submissions as it deems fit.

(3) The Committee may, if it deems necessary, ask for more information or documentation from the CIP Department, or where designated the competent authority, or from the entity concerned.

(4) Whenever the Committee establishes that an entity has not complied with this order or has not taken the necessary supervisory or enforcement measures in accordance with this order, it shall impose an administrative fine.

(5) In its decision the Committee shall indicate the amount of the administrative penalty and a timeframe within which the entity concerned shall pay the administrative penalty, as well as a timeframe within which the entity is to remedy the breach. The Committee shall give reasons for its decision.
