S.L. 427.63 Art. 7Lift modernisation.

(1) The existing lift that has been thoroughly examined by an ACAB shall be upgraded according to the ACAB’s report.

(2) The ACAB shall determine, on the basis of the risk analysis performed during the thorough examination, the serious risks requiring immediate attention and those requiring modernisation works.

(3) A technically qualified person selected by the responsible person shall carry out the modernisation works and the responsible person shall be responsible for all the expenses involved in such modernisation.

(4) On completion of the modernisation works, the responsible person shall inform the ACAB, which will check if all necessary alterations have been carried out and shall issue a regularisation certificate:

(a) in the case of lifts not installed in a workplace, the responsible person shall forward a copy of the regularisation certificate to the Authority within fifteen (15) days;

(b) in the case of lifts installed in a workplace, the responsible person shall forward a copy of the regularisation certificate to the OHSA within fifteen

(15) days.
