S.L. 425.16 Art. 6Transhipment.

(1) Any transhipment of BFT must:

(a) take place at a port designated for such a purposes by the Director, and subject to a specific authorisation for each transhipment;

(b) be subject to a seventy-two (72) hour prior notice by a representative of the vessel concerned;

(c) be subject to the provision of any documents and information required by the Director, in particular documents and information required according to international law and European Union law.

(2) The Director shall not authorise any transhipment unless the competent authority of the flag of the vessel provides its own authorisation for the transhipment.

(3) The Director may issue a transhipment authorisation according to this regulation if he is satisfied that the provisions of sub-regulations (1) and (2) have been met by the concerned operators.
