Without prejudice to the second proviso to regulation

12(1), where the organiser is established outside the European

Economic Area, a retailer established in Malta shall be subject to the obligations laid down for organisers in regulations 12 to 17, unless the retailer provides evidence that the organiser complies with those regulations.
