S.L. 370.32 Art. 42Applicability of Part 4a to depositaries providing custody services to AIFs prescribed in regulation 38(1)(b).

(1) A depositary lite which provides custody services to

AIFs referred to in regulation 38(1)(b) shall, in addition to the regulations prescribed in Part 2 applicable to depositaries of all collective investment schemes, also be regulated by regulations

30(2), 31, 32(1), 33 and 37 of Part 4a:

Provided that one or more entities may be appointed to carry out the functions referred to in regulations 31, 32(1) and 33.

(2) A Category 4b Investment Services Licence Holder as referred to in sub-regulation (1) shall also comply with regulations 43 and 44.
