S.L. 370.32 Art. 40Eligibility criteria.

The following entities shall be eligible to provide depositary services to AIFs as referred to in regulation 38(1):

(a) entities, other than UCITS management companies and AIFMs, that are licensed under the Act to provide, or hold themselves out as providing, any of the investment services stipulated in the First Schedule to the Act, other than those stipulated in items 3, 5, 7, 9 and 11, in or from Malta and to hold or control clients’ money or customers’ assets;

(b) Recognised fund administrators in possession of a Recognition Certificate issued in terms of article 9A of the Act.
