S.L. 330.9 Art. 51Recovery and reorganisation measures to accompany bail-in.

(1) Where the Resolution Committee applies the bail-in tool to recapitalise an institution or entity referred to in paragraphs

(b), (c) or (d) of the definition "entity" in regulation 2(1) in accordance with regulation 43(2)(a), arrangements shall be adopted to ensure that a business reorganisation plan for that institution or entity is drawn up and implemented in accordance with regulation 52.

(2) The arrangements referred to in sub-regulation (1) may include the appointment by the Resolution Committee of a person or persons appointed in accordance with regulation 72(1) with the objective of drawing up and implementing the business reorganisation plan required by regulation 52.
