S.L. 276.5 Art. 73ETime limits for surrender of persons enjoying privilege, etc.

(1) Where the person in respect of whom a Part II warrant is issued, enjoys a privilege or immunity regarding jurisdiction or execution in Malta, the time limits for surrender shall not start running unless, and counting from the day when, the court is informed of the fact that the privilege or immunity has been waived.

(2) Where power or authority to waive the privilege or immunity lies with the Maltese authorities, the court shall forthwith request the relevant authority to exercise that power.

(3) Where the power or authority to waive the privilege or immunity lies with an authority of another State or international organisation, the judicial authority issuing the Part II warrant shall request it to exercise that power.
