S.L. 276.5 Art. 12Decision on whether offence is an extraditable offence.

(1) Where a person in respect of whom a warrant as is referred to in article 5(2) has been issued is brought before the court for the extradition hearing the following provisions shall apply.

(2) The court must decide whether the offence specified in the warrant is an extraditable offence.

(3) If the court decides the question in sub-article (2) in the negative it may, after considering all the circumstances of the case on their own merits, order the person’s discharge.

(4) If the court decides that question in the affirmative it must proceed under article 13.
