These regulations shall apply to ro-ro passenger ships and high-speed passenger craft registered in terms of Article 3 of the Act, and operating on a regular service between a port in Malta and a port in a third country:

Provided that these regulations shall not apply to ro-ro passenger ships and high-speed passenger craft falling within the scope of Directive 2009/16/EC on port State control.
