S.L. 217.27 Art. 9Applications for admission.

(1) An application for an EU Blue Card shall be submitted by the employer.

(2) An application for an EU Blue Card shall be considered and examined when the third-country national concerned is residing outside Malta, or when he is already residing in Malta as a holder of a valid residence permit or long-stay visa.

(3) By way of derogation from sub-regulation (2), the competent authority may accept an application for an EU Blue Card submitted by the employer of a third-country national who is not in possession of a valid residence permit or long-stay visa but is legally present in Malta.
